Digital Playground Terms of Service

These Terms of Service govern your access to and use of the Digital Playground website, dashboard, WhatsApp API services, bulk messaging services, and any related offerings. By accessing our website or using our services, you agree to be bound by these Terms and applicable Meta policies for the WhatsApp Business Platform.

1. Agreement to Terms

By visiting our website, contacting us for service, purchasing a plan, or using any Digital Playground product, you confirm that you have read, understood, and agreed to these Terms of Service. If you do not agree, please do not use our services.

2. Service Description

Digital Playground provides support and infrastructure assistance for official WhatsApp API onboarding, bulk messaging workflows, campaign operations, dashboard access, and related business communication services. We may also offer website development, digital marketing support, custom projects, and educational project services as secondary offerings.

3. Authorized Use

You agree to use the service only for lawful, ethical, and platform-compliant business communication.

You agree not to use Digital Playground for any of the following:

  • Sending adult content, gambling promotions, illegal drug promotions, or any content prohibited by law or by Meta.
  • Sending deceptive, fraudulent, abusive, or harmful campaigns.
  • Spamming users who have not opted in to receive your messages.
  • Using purchased, scraped, or unauthorized contact lists.
  • Attempting to bypass content moderation, verification rules, platform restrictions, or billing obligations.

4. Account Responsibility

You are responsible for the accuracy of the information you provide for onboarding, billing, and business verification. You are also responsible for maintaining the confidentiality of your login details, API credentials, and internal user permissions. Any activity carried out through your account is your responsibility unless caused directly by our negligence.

5. Meta and Platform Compliance

You acknowledge that Digital Playground acts as a facilitator and service partner for official WhatsApp API usage. Final approval, enforcement, template review, number quality rating, and business account standing remain subject to Meta's rules and decisions.

Any changes in Meta pricing, throughput, template rules, verification requirements, or API policies may affect your service. Where relevant, we will communicate material changes with reasonable notice, including the 30-day notice period referenced for pricing or policy pass-through changes where applicable.

6. Payments and Credits

All listed pricing is subject to change with notice. Payments for Credit Packs are final unless otherwise required by law. Credits remain valid for 12 months from the date of purchase unless a different validity period is stated in writing at the time of sale.

Monthly plans may renew based on the active billing arrangement. Failure to make payment may result in service pause, restricted dashboard access, or account suspension.

7. Account Suspension and Termination

Digital Playground reserves the right to suspend or terminate accounts that violate these Terms, misuse the platform, engage in prohibited activity, fail compliance checks, or generate high Report/Block rates from WhatsApp users. We may also restrict access where required by Meta policy, law, payment risk review, or security concerns.

8. Service Availability

We aim to keep services reliable and responsive, but uptime is not guaranteed at all times. Service interruptions may occur due to maintenance, hosting issues, internet disruptions, third-party outages, Meta platform changes, or events outside our control.

9. Intellectual Property

Unless otherwise agreed in writing, the Digital Playground name, website design, service materials, branding, and original content remain our intellectual property. You retain ownership of your own business data, message content, brand assets, and uploaded materials, subject to the rights necessary for us to provide the service.

10. Limitation of Liability

To the fullest extent allowed by law, Digital Playground is not liable for indirect, incidental, special, or consequential damages arising from the use of our service. We are not liable for business losses caused by Meta suspending, restricting, reviewing, or disabling your WhatsApp Business Account due to your own violation of messaging rules, template policies, business verification issues, or other platform compliance requirements.

11. Indemnity

You agree to indemnify and hold Digital Playground harmless from claims, losses, liabilities, and costs arising out of your misuse of the service, violation of these Terms, violation of third-party rights, or breach of applicable law or platform policy.

12. Changes to Service or Terms

We may update, modify, pause, or discontinue any part of the service where necessary for operational, legal, or commercial reasons. We may also revise these Terms from time to time. Continued use of the website or service after updates become effective means you accept the revised Terms.

13. Governing Principles

These Terms will be interpreted in accordance with applicable laws governing our operations, subject to any mandatory consumer protections or regulatory rules that may apply based on your location or contract type.
